The court threw out nothing. The court never got a look at Nel's case.
The prosecutors, of which he is one, withdrew the case. The court
judge was left gaping like a goldfish in a bowl. The prosecutors acted
as judges in the case of one of their own members. It has been noted.
Jackie Selebi's courageous action in attempting to force the Scorpions
to charge him or leave him alone, alas not yet successfully, has
turned the tide for him in the movement. He had been suffering from a
label as an "Mbeki crony", on no basis at all (Mbeki has no cronies,
only dangerous liaisons) but that is out of the way now.
Both court cases last week were highly necessary for justice. They are
on the record. The NPA will drag their feet again now because their
case is only winnable with a big following wind and intimidated
judges. In the Selebi case we are back to where we were with the Zuma
case in 2006 when the NPA had to be forced to court, and then turned
out not to have a case.
The following wind is not there. You, Everatt, are looking at a
thinly-based spectacle, not seeing what the masses see, which may
resemble more the following quote from an e-mail forum:
"Even though one of the resolutions taken in Polokwane was to
incorporate the Scorpions in the Police, there is big problem lying
ahead with this merger.
"Don't forget that the DSO consists of mainly 70% or more retired
special branch police who served apartheid regime very well. Prior
1994 elections most of them took their fat packages as they were not
willing to serve or work for a black (sorry) government. Comrades, do
you really think they can cooperate with the police? Mark my words,
most of them will form groups within SAPS.
"We might say certain people are using the Scorpions & NPA to push
their agenda, however the bottom line is that the special branch
police or you might call it Scorpions will still continue with their
war or struggle against the so called terrorists (blacks) until there
chaos in the country. A thorough screening should be done to the
special branch police before they can join SAPS
"The sad part is that these people are given opportunity to join the
police while most of the former liberation armies are languishing in
jails, unemployed and begging in the street corners. I just hope and
wish that our new NEC members will be more visible and visit branches
where people can have their say regarding issues of the movement."
